          Sub: Withholding of pay & allowance while on leave on medical ground.

Dear Sir,
          We are looking with great concern that pay and allowances of the officials, who are on leave on medical ground , are being withhold abruptly and generally under your orders. When the officials are on EL with MC, they face financial hardship due to their medical expenses. As there is no other source of income except salary, their family is to remain in starvation and medical treatment is hampered badly. So, it is very inhuman to withhold the pay & allowances of the officials, who are on leave with MC.
These Unions therefore, urge upon you kindly to release the pay & allowances of the employees, who are on leave on medical ground and to refrain yourself from such work henceforth.

Sub: Circulation of important orders to unions and payment through salary account.

Dear Sir,
              Kindly refer to our letter of even no dated 13.05.2013 , in which you were requested to supply all Govt orders, general letters, orders, circulars, circle orders, correction lists, unclassified circulars etc to the service unions in future, following the DG(P) No 10-4/2003-SR dtd 25.04.2003 and 16-1/61-SR dtd 20.06.62 & reiterated in No. 16-46/92-SR dtd 10.03.1993 and DG(P) NO. 10-12/2005-SR dated 07.02.2007 .
You were also requested to supply the copy of the DTE’s order regarding the payment of salary through the Salary Account and your circular in this connection and your circular regarding joining time. But sorry to say that neither the letter has been acknowledged nor any reply has been received from your end till this day.
However we have collected a copy of O.M No-2-1/2007-08-PA(Tech.I) dtd 14.05.2009 circulated vide C.O. letter no MM&PO/P-4/01/08 dated 08.06.2009, in which it is clearly mentioned “the payment of pay and allowances to all the employees of this Department shall be made through cheque and /or through direct credit to the salary/ savings accounts of the employees concerned, maintained in any of the banks governed by the Reserve Bank of India regulations”.
But your circular regarding opening of Salary account does not corroborate with the DTE’s circular. In fact you are ceasing the facility of choosing various Banks from the employees.
These unions therefore, urge upon you kindly to extend the facility of choosing various bank to the employees for opening of salary account, otherwise continue paying monthly salary through A-Roll system.

            It is learnt that an order of posting of Sri Barun Kumar Mondal and Debasish Ghosh, who are now on Induction Training, has been issued as SPM, Reapara S.O. & SPM, Paramanandapur S.O. respectively. Both the offices are now single handed and both of the trainee PAs  are new and do not know all the works of the Department. Therefore, they should not be posted in a single handed office/ in charge of an office. Their first posting should be in big (Head Office or Sub offices other than single hand) offices. The posting order is also violating the existing orders of the Department.
This union therefore, urge upon you to post Sri Barun Mondal & Sri Debasish Ghosh at Tamluk Head Post Office cancelling the present order of posting.

            DG(P) No-10-3/87-SR dtd 8.3.1988 clearly states “ the letters received from the recognized Unions/Associations at various levels should be acknowledged promptly and the matter in question decided as expeditiously as possible . If the decision in the matter is likely to get delayed for some time an interim reply should invariably be sent to the concerned Union/Association”.

Dear Sir,
You are already aware about the fact of physical assault to Sri Panchanan Maity, Offg.BPM, Dakhin Narikelda B.O by Sri Bablu Pattanayak, one miscreant, on 11/5/2013. Sri Maity was heavily injured and had to take medical treatment. He also filed a police diary to the O/C, Nandakumar PS. But no action has been taken against the culprit so far.
As Sri Maity was physically assaulted during performing his duty, the Dept. has the responsibility to protect his employee.
This Union therefore, urge upon you to take an urgent appropriate action so that the Culprits may be punished soon and to take urgent preventive measure for the security of the officials.

Sub: Whimsical order of ‘Dies-Non”-case of Bidyut Maity.

Dear Sir,
            It has come to the notice of this union that you have issued a whimsical order of ‘Dies-Non’ for all purposes for the days of 22.04.2013 & 23.04.2013 , in connection with absence of Sri Bidyut Maity, PA, Moyna S.O., without giving him any opportunity to submit representation and without confirming about the fact.
Sri Maity duly informed about his absence to the concerned SPM and another PA of his office over telephone   and later submitted an application for CL(casual leave) on resuming his duty. So the question of unauthorized absence is baseless and it is presumed that you have intentionally and biasly  issued the order of ‘Dies-Non’ against Sri Maity.
This union, therefore, urge upon you for immediate cancellation of your order No-B/B-40/TMK/13-14 dtd 29.04.2013 and immediate payment of cut-salary  for those days.

This union, therefore, urges upon you to make regular arrangement in the above-noted vacant posts on seniority basis ,to give necessary approval for present arrangement and remove the Acctt, Divl Office from the post of APM(A/Cs) by local arrangement from the available senior BCR officials of the station.

Sub: Irregular order of deputation.

Dear Sir,
            It is noticed that senior officials are being directed for deputation in the leave vacancy / permanent vacancy in the S.Os, despite availability of the junior officials. We are noticing this practice in Tamluk H.O and some S.Os and by this way only our members are being hackled. For example- Srikrishna Pramanik had been given direction while junior official was available at Tamluk H.O., Bidyut Maity of Moyna S.O. is being directed when his junior is available etc. It is also seen that in maximum cases of direction only our members are ordered to go for direction. For example now Srikrishna Pramanik, kamal Biswas , Susanta Mistry and Tamal Kanti Manna of tamluk H.O. are on deputation and all are only our members. It seems to us that these are being done intentionally.
This union therefore ,urge upon you kindly to remove disparity and favouritism while giving the deputation.

          In response to your letter under reference, respectfully I beg to state that when the RPLI policies ranging from block No-2100000 to 2102600 were procured at Tamluk Division, I was not in the RPLI Section/Branch and so far I remember, the works were done at different section/ branches of Divisional Office viz. RPLI works of Mahishadal Sub Division were entrusted to Fraud Br, RPLI works of Haldia Sub Division were entrusted to Mail Br. etc. It will be clear if the concerned RPLI register consisting details of the policies ranging from block No-2100000 to 2102600, is consulted. And so far my knowledge goes , all the section/ branches forwarded the policies to the DDM(PLI), Kolkata at that period for further acceptance.

          So, the question of negligence of duty for non processing of RPLI policies ranging from block No-2100000 to 2102600 while working in the RPLI Section / Branch of Tamluk Division does not arise. I am always sincere and devoted to my duties, that’s why as per request of the then Superintendent I tried to install web based RPLI software after consultation with NIC, Tamluk and Contai Divisional Office and generation of policy bonds of new RPLI policies started at Tamluk Division for such initiatives  though I had no training on that subject.

          Despite if any mistake had been committed  by me during working at Divisional Office I may be excused.

          Hope this information will be sufficient otherwise if the RPLI Register, RPLI files of different branches  of that period, order book, memo of distribution of work, Nominal Roll (or related document by which it can be known who worked in which branch and which period) etc be supplied to me, I may furnish details if you require.

Dear Sir,
          It has come to the notice of this union that the following officials of this Division have applied for transfer under Rule-38 but their cases are not yet settled.
1.  Begam Sabnam Rahaman Laskar now SPM Haldia TS resided alongwith her full family consisting of her husband and two studying daughters at P&T Staff Quarter Complex,Haldia. But consequently on compulsory voluntary retirement of her husband from HFC, Haldia (Closed down) in the year 2003, the members of her family shifted to their permanent residence at Entally, Kolkata. Since then Begam Sabnam is feeling difficulty to get together with family. She applied  for transfer under Rule-38 to South Presidency Division in the year 2006. But disposal of her application is still in the dark. Again she applied for transfer under Rule-38 to East Kolkata Division on 21.04.2010. It is learnt that her application has been forwarded to R.O. without recommendation on 19.05.2010.
2.  Smt Indrani Dutta now SPM ,Durgachak SO resided alongwith her  family consisting of her husband and one studying daughters at P&T Staff Quarter Complex, Haldia. Her husband also retired from Exide, Haldia in the year 2010. The members of her family shifted to their permanent residence at Nager Bazar, Kolkata. Like  Begam Sabnam, she is also feeling difficulty to get together with family. She applied  for transfer under Rule-38 to North Kolkata Division on 04.01.2010. It is learnt that her application also has been forwarded to R.O. without recommendation.
It is noticed that some cases, submitted later have already been settled without giving priority to earlier cases.
This union therefore, urges upon you to settle the cases as early as possible in order to minimize the sufferings being faced by the above noted lady staff.

Irregular issue of Rotational Transfer memo in the middle of the academic session was the number 2 item of discussion. Accordingly we have requested  you vide our letter dtd 09.04.2013 (received by you during demonstration)  not to take any initiative for implementation of transfer memo before such discussion on 23.4.2013.
We are sorry to say that our request has not been kept as you are pressing hard to implement the transfer memo immediately. Thus the Divisional Head himself break his assurance for discussion on 27 items of discussion.

                                                 RESOLUTION              
This  joint stay in demonstration, held today on 08.04.2013 in the premises of O/O the Superintendent of Post Offices, Tamluk Division notes with utter dismay the autocratic attitude of Sri Sasanka Sekhar Hazra, Supdt of P.Os ,Tamluk Division since his first day of joining i.e. on 01.04.2013.
From the very first day of his joining , Sri Hazra is showing his ferocious attitude towards staffs, Postmaster and union representatives. He informed his unwillingness to discuss any matter with union representatives even he threatened the representatives to make a call over telephone. He started issuing threatening and insulting letters/ orders without consulting the file. He stays morethan 4 hours a day with a lady official in his chamber.
We can’t follow any reason behind his such high handed and autocratic behavior since his first day of joining. All staffs are very much agitated and total working environment of this Division thus spoiled.
This stay in demonstration urges upon the authority to take an urgent action against such activity and demand immediate transfer of Sri Hazra to maintain peace in Tamluk Division.

Dear Sir,
            With reference to your letter cited above, it is stated that the undersigned can’t remember whether our letter dtd 2.4.2013 was unsigned. However a signed copy of our letter dtd 2.4.13 is sent herewith.
            You have intimated that all guidelines have been followed while issuing the Rotational Transfer memo but what we demanded in our previous letter that transfer memo should not be effected in the middle of the academic session, is not followed. And DG(Post)’s guidelines in this regard vide DG(P) No-141-4/98-SPB II dtd 23.02.1998 is very much clear. But your action is opposed to such order.
We had demanded an immunity of transfer of Secretary and Treasurer nowhere in our letter dtd 2.4.2013, yet you have written the issue in your reply irrelevantly. And a recognized Service Union can, not only take up the issue for “immunity transfer of Secretary and Treasurer” but also has every right to raise issues against any order, issued in contravention of rule relating to service matters.
You are therefore again requested to keep in abeyance the transfer memo dtd 28.02.2013, which is issued against the order of the DG(P) .
Regarding sending of union correspondences through messenger noting into Peon Book, is an elongated method which is being followed at all levels of the administration; even your predecessors received our correspondences by putting their own signatures in peon book.
You are therefore also requested to intimate under what authority you have ”asked” the Divisional Secretary to “intimate the authority of Union, sending union letter in the Peon Book, to the Divisional Head as well as engaging one GDS Staff for such matter”. Relevant ruling portions may kindly be supplied immediately.

            We are demanding for timely tenure transfer & Posting since long . Accordingly options were invited from the officials in due time but the same tradition of issuing tenure transfer memo beyond the academic session is going on, violating the DGP No-69/4/79/SPB I dt 12.11.81 & subsequent orders , in which it is clearly indicated that the transfer memo may not be effected in the middle of the Academic session.
            We expected proper implementation of existing ruling of the Department and proper justice from a Divl head. But sorry to say that he failed to do so.
            Moreover the options of the officials regarding their choice of place have not been followed.
            We are looking with great concern that no arrangement has been taken to relieve the SPMs, of single handed Post offices, whose transfer memo was issued last year. No permission has been taken for such overstayal at single hand post office.
            Not only that we have noticed no initiative of the Divl head to implement the last year  rotational transfer memo before starting of this academic session.
            No one has been posted as APM at Tamluk H.O though there are total vacancy in the APM posts.
We had raised several objections regarding dealing of union files, files related to staff matters and other sensitive files should not be handled by an active member of Union. But still the active member of our rival union is dealing the files.  Thus the members of our rival union are being totally facilitated.
In these circumstances this union urge upon you kindly to keep in abeyance the  transfer & posting memos issued on 28.03.2013 immediately.

Dear Sir,
          This is regarding one day strike on 12.12.12 and implementation of pay cut thereof. We have demanded to follow “No work no pay principle” invariably while implementation of pay cut order. Accordingly you have agreed to refer the case to R.O. and after getting the clarification from R.O. pay cut order will be implemented. In this respect you have also given a written order to the Postmaster, Tamluk H.O. vide your letter no-B-2/Postal Strike/12.12.2012/TMK dtd 24.01.13.                                                     After that R.O clarified vide there letter no-PMG(SB)/strike/12-12-2012 dtd 29.01.2013 that “those who had attended office are entitled to ‘pay’ ”.
Our beloved circle union then took up the issue at appropriate level against the irregular order of the R.O and the said clarificatory order of the R.O.  has since been dropped. So the “No work no pay principle” yet to be clarified properly. Accordingly our agreement for not to implement the pay cut order till the receipt of the clarification of “No work no pay” principle still stands.
These unions therefore urge upon you kindly not to implement the pay cut order in c/w one day strike on 12.12.12, till receiving of proper clarification of “No work no pay” from the higher authority.

Sub: Protest against misbehavior of Divisional head with the union representatives.
                           
Dear Sir,
          We met you in your chamber on 25.03.2013 in connection with discussion of some burning problems of this division with your due permission. In course of discussion you misbehaved with our representatives in such a way  that our members are not only dishonored  but also shocked. It was noticed that you had shown totally non co-operation to solve the problem by mutual understanding and refused to discuss the matter any more. We feel insulted. Under the circumstances we had no other alternative but to walk out from your chamber.
          We protest against such high-handed attitude of a divisional head towards union representatives. We are organizing a day long demonstration in front of your chamber to raise our voice against such behavior. We hope the administration will not forget to maintain sweet relation between the administration and Union.

                                                 RESOLUTION              
This  joint stay in demonstration, held today on 26.03.2013 in the premises of O/O the Superintendent of Post Offices, Tamluk Division notes with utter dismay the autocratic attitude of Sri Basudeb Sadhu, Supdt of P.Os ,Tamluk Division.
That on 25.03.2013 , union representatives met with the said SPOs, Tamluk Division on his permission to discuss some divisional problems. From the very beginning of discussion he showed non co-operation and high-handedness . He had also no intention to continue the discussion and solve the problem. Union representatives felt dishonored by his autocratic and painful attitude and they had no other alternative but to walk out on protest.
This stay in demonstration urges upon the authority to take action against such activity and demand to solve the burning problems of this division by maintaining sweet relation between union and administration.
