Sub: Transfer under Rule-38 .
Dear Sir,
It has come to the notice of this union that the following
officials of this Division have applied for transfer under Rule-38 but their
cases are not yet settled.
1. Begam
Sabnam Rahaman Laskar now SPM Haldia TS resided alongwith her full family
consisting of her husband and two studying daughters at P&T Staff Quarter
Complex,Haldia. But consequently on compulsory voluntary retirement of her
husband from HFC, Haldia (Closed down) in the year 2003, the members of her
family shifted to their permanent residence at Entally, Kolkata. Since then
Begam Sabnam is feeling difficulty to get together with family. She
applied for transfer under Rule-38 to
South Presidency Division in the year 2006. But disposal of her application is
still in the dark. Again she applied for transfer under Rule-38 to East Kolkata
Division on 21.04.2010. It is learnt that her application has been forwarded to
R.O. without recommendation on 19.05.2010.
2. Smt
Indrani Dutta now SPM ,Durgachak SO resided alongwith her family consisting of her husband and one
studying daughters at P&T Staff Quarter Complex, Haldia. Her husband also
retired from Exide, Haldia in the year 2010. The members of her family shifted
to their permanent residence at Nager Bazar, Kolkata. Like Begam Sabnam, she is also feeling difficulty
to get together with family. She applied
for transfer under Rule-38 to North Kolkata Division on 04.01.2010. It
is learnt that her application also has been forwarded to R.O. without
recommendation.
It is noticed that some cases, submitted later have already been settled
without giving priority to earlier cases.
This union therefore, urges upon you to settle the cases as early as
possible in order to minimize the sufferings being faced by the above noted
lady staff.

Sub: Implementation of rotational transfer memo .
Dear Sir,
During stay in demonstration held on 08.04.2013 &
09.04.2013 at your office premises, you have agreed to discuss upon 27 items of
Discussion and the date for such
discussion has been fixed on 23.04.2013. Irregular issue of Rotational Transfer
memo in the middle of the academic session was the number 2 item of discussion.
Accordingly we have requested you vide
our letter dtd 09.04.2013 (received by you during demonstration) not to take any initiative for implementation
of transfer memo before such discussion on 23.4.2013.
We are sorry to say that
our request has not been kept as you are pressing hard to implement the
transfer memo immediately. Thus the Divisional Head himself break his assurance
for discussion on 27 items of discussion.
These unions therefore
again urge upon you to retrain yourself from implementation of Tenure transfer
memo immediately.

RESOLUTION
This joint stay in demonstration,
held today on 08.04.2013 in the premises of O/O the Superintendent of Post
Offices, Tamluk Division notes with utter dismay the autocratic attitude of Sri
Sasanka Sekhar Hazra, Supdt of P.Os ,Tamluk Division since his first day of
joining i.e. on 01.04.2013.
From the very first day of his joining , Sri Hazra is showing his
ferocious attitude towards staffs, Postmaster and union representatives. He
informed his unwillingness to discuss any matter with union representatives
even he threatened the representatives to make a call over telephone. He
started issuing threatening and insulting letters/ orders without consulting
the file. He stays morethan 4 hours a day with a lady official in his chamber.
We can’t follow any reason behind his such high handed and autocratic
behavior since his first day of joining. All staffs are very much agitated and
total working environment of this Division thus spoiled.
This stay in demonstration urges upon the authority to take an urgent
action against such activity and demand immediate transfer of Sri Hazra to
maintain peace in Tamluk Division.

Ref: Your letter No-B-22/Arrgt/Transfer&Posting/TMK/12-13 dt 2.4.13
Dear Sir,
With reference to your letter cited above, it is stated
that the undersigned can’t remember whether our letter dtd 2.4.2013 was
unsigned. However a signed copy of our letter dtd 2.4.13 is sent herewith.
You have intimated that all guidelines have been followed
while issuing the Rotational Transfer memo but what we demanded in our previous
letter that transfer memo should not be effected in the middle of the academic
session, is not followed. And DG(Post)’s guidelines in this regard vide DG(P)
No-141-4/98-SPB II dtd 23.02.1998 is very much clear. But your action is
opposed to such order.
We had demanded an immunity of transfer of Secretary and Treasurer
nowhere in our letter dtd 2.4.2013, yet you have written the issue in your
reply irrelevantly. And a recognized Service Union can, not only take up the
issue for “immunity transfer of Secretary and Treasurer” but also has every
right to raise issues against any order, issued in contravention of rule
relating to service matters.
You are therefore again requested to keep in abeyance the transfer
memo dtd 28.02.2013, which is issued against the order of the DG(P) .
Regarding sending of union correspondences through messenger noting into
Peon Book, is an elongated method which is being followed at all levels of the
administration; even your predecessors received our correspondences by putting
their own signatures in peon book.
You are therefore also requested to intimate under what authority you
have ”asked” the Divisional Secretary to “intimate the authority of
Union, sending union letter in the Peon Book, to the Divisional Head as well as
engaging one GDS Staff for such matter”. Relevant ruling portions may kindly be
supplied immediately.
