Sub: Pay cut due to participation in one day strike on 12.12.12 by Confederation.

Dear Sir,

Kindly recall our earlier letters & verbal discussion held with you at your chamber on 21.01.2013 regarding withheld of pay & allowances for the strike dtd 12.12.2012.

We had intimated you clearly that either deduct one day’s salary of the strikers along with the employees, who did not performed any work on 12.12.2012 following the ‘NO WORK NO PAY’ Principle or stop deduction of one day’s salary for all employee to avoid severe Trade Union activities and smooth running of the division. But nothing resulted favourably.

You are therefore again reminded our demand requesting you to restrain yourself from taking any controversial decision, which may brought unstable /unrest situation in Tamluk Division.

It is also intimated that a demonstration will be conducted by our members tomorrow in front of your chamber in the afternoon to raise our voice protesting such type of your partial activity.

It is learnt that you have ordered the Postmaster, Tamluk H.O to cut one day’s salary from the pay of the participants of the one day strike , held on 12.12.12. A list of such officials is also enclosed by you.

In this regard, we like to intimate you that most of the offices under Tamluk Division were closed on 12.12.12. On the very next day only some offices sent blank S.O/ B.O daily account. So it is very clear that the offices were actually closed and the officials of those offices didn’t perform any work.

You are also requested to recall our letter dated 20.12.12, wherein the detailed picture of Tamluk H.O was depicted for your kind knowledge and to take action accordingly. You are well known from the reports of the Postmaster, Tamluk H.O, various Medias like leading Newspaper, Cable TV channels and our verbal and written report that some members of FNPO union entered into Tamluk H.O on 12.12.12 with some political goons but they actually performed no work on that day.

As per verdict of Supreme Court upheld in the Civil Appeal No. 2581 of 1986, communicated vide OM No. 41016/1(S)/90/Estt.B dt. Ist May, 1991 –

“It is not enough that the employees attend the place of work. They must put in the work allotted to them. It is for the work and not for the mere attendance that the wages/ salaries are paid”.

It is evidentially proved that the officials especially of Tamluk H.O didn’t perform any work on 12.12.12. So they must be treated as per the judgment, of the Hon. Supreme Court , communicated by GoI OM No. 41016/1(S)/90/Estt.B dt. Ist May, 1991.

The exclusion of the names of such officials from the list is totally motivated. We condemn such partial act of the Divisional head.

These unions also seriously observed that huge problems of staffs are accumulated in our division & we are demanding again and again for monthly meeting and deputations, that are not being heard due to shortage of time . Our agendas are not being settled years after years . But the same Divisional head is so much active /prompt on the question of pay cut ? More over the Strike file is maintained by an important office bearer of our rival union, which is also against the orders.

These unions therefore, urge upon you kindly to include all the names of the officials of Tamluk Divion in the pay cut list following the “No work no pay” principle or to stop deduction of one day’s salary immediately to avoid agitations.
